Question 1

How do I know if I qualify for the IRS Fresh Start Program?

Accepted Answer

You may qualify if you owe $50,000 or less in taxes, penalties, and interest, are current on all required tax filings, and can demonstrate financial hardship or inability to pay the debt in full. Self-employed individuals may qualify with a 25% or more drop in income. The key is proving genuine financial hardship. The IRS requires applicants to submit financial records including income, expenses, and asset documentation to assess their ability to pay. We help you prepare this documentation properly to maximize your chances of approval. Even if you owe more than $50,000, you may still qualify by making a partial payment to reduce the balance to meet the threshold. During our free consultation, we'll review your specific situation and determine which Fresh Start options are available to you.

Question 2

What's the difference between an Offer in Compromise and installment agreement?

Accepted Answer

An Offer in Compromise allows you to settle your tax debt for less than the full amount you owe if paying the full liability would create financial hardship. This is actual debt forgiveness - you pay a reduced amount and the rest is wiped clean. An installment agreement lets you pay off the full debt over time through monthly payments, with plans lasting up to 72 months for debts under $50,000. Once approved, the IRS stops collection efforts and penalties, though interest continues until the balance is zero. The IRS generally approves an Offer in Compromise when the amount offered represents the most they can expect to collect within a reasonable period. The program now considers your current income and assets rather than future earning potential, making it more accessible than before.

Question 3

Will the IRS still contact me once you take my case?

Accepted Answer

No. Once we establish representation, all IRS communication goes through us. We immediately take over and contact the IRS and/or State Agency and establish representation. This means no more intimidating phone calls, threatening letters, or surprise visits. The IRS suspends other collection activities while we work on your case. We contact the IRS on your behalf and stop their collection tactics in their tracks, then begin investigating and planning a tax relief program. You'll have complete peace of mind knowing that trained professionals are handling all aspects of your case. We keep you informed of progress, but the stress of dealing directly with IRS agents is completely eliminated. You deserve an advocate in your corner fighting for the best possible solution.

Question 4

How long does the Fresh Start Program process take?

Accepted Answer

The timeline varies depending on which Fresh Start option fits your situation. Streamlined installment agreements have reduced documentation requirements and faster approval processes. These can often be approved within 30-60 days. Offers in Compromise are automatically accepted if the IRS doesn't make a determination within two years of receipt. However, most cases resolve much faster when properly prepared and presented. Every day you delay, penalties and interest continue accumulating. That's why we recommend starting immediately. During your free consultation, we'll give you a realistic timeline based on your specific circumstances. We typically need only about 15 minutes to understand your situation and have the perfect solution in mind.

Question 5

Can I handle Fresh Start applications myself without professional help?

Accepted Answer

You can learn how to settle your debt with the IRS on your own, but success rates are significantly lower without professional representation. The Offer in Compromise Program is not for everyone, and you should check the qualifications of any tax professional you hire. The IRS is the most powerful collection agency in the world and it can be very intimidating and frustrating to deal with them on your own. Tax law is complex, and small mistakes in documentation or procedure can result in denial of your application. Would you go to court without a lawyer? Of course not! Then why would you go before the IRS without a trusted tax professional? The IRS requires detailed financial records and documentation to assess your ability to pay, ensuring the program is reserved for those who genuinely need relief. We know exactly how to present your case for the best possible outcome.
