Question 1

How Much Can The IRS Fresh Start Program Reduce My Tax Debt?

Accepted Answer

The amount depends on your specific financial situation and which Fresh Start option you qualify for. Offers in Compromise allow you to settle your tax debt for less than the full amount you owe, and eligible taxpayers may be able to reduce 90% or more of what they owe if you meet the IRS criteria for doubt as to collectibility—meaning you can't pay the full amount without creating financial hardship. Penalty abatement can save thousands of dollars for eligible taxpayers, often eliminating failure-to-file and failure-to-pay penalties that make up a significant portion of your total debt. For example, if you owe $20,000 and half consists of penalties, penalty abatement could cut your debt to $10,000. Currently Not Collectible status doesn't reduce your debt but stops all collection activities if you're experiencing genuine financial hardship. The key is working with experienced professionals who know exactly which option gives you the maximum benefit based on your circumstances and financial capacity.

Question 2

Do I Qualify For The Fresh Start Program In Pennsylvania?

Accepted Answer

You may qualify for the Fresh Start Program if you owe $50,000 or less in taxes, penalties, and interest, are current on all required tax filings, and can demonstrate financial hardship or inability to pay the debt in full without economic strain. Self-employed individuals may qualify if they show a drop of 25% or more in income. The IRS also considers your assets, monthly income, and necessary living expenses when determining eligibility for specific programs like Offers in Compromise. The Fresh Start initiative made adjustments to how people qualify for Offers in Compromise, making it accessible to more people and simpler to apply for and qualify. Pennsylvania residents face additional complexity because state tax debt doesn't qualify for federal Fresh Start programs. However, Pennsylvania offers its own relief options including Deferred Payment Plans and limited Offer in Compromise situations for taxpayers in certain circumstances. We evaluate both your federal and state tax situations to maximize your overall relief.

Question 3

How Long Does The Fresh Start Program Take To Complete?

Accepted Answer

Timeline varies significantly based on which program you use and the complexity of your case. Streamlined installment agreements for taxpayers owing up to $50,000 can be set up for up to 72 months and often get approved within 30-60 days since they require minimal financial documentation for qualifying taxpayers. Offers in Compromise are automatically accepted if the IRS doesn't make a determination within two years of the IRS receipt date (this does not include any appeal period). Most OIC cases resolve within 6-12 months from submission to final decision, though the IRS has up to 24 months to review your offer. Penalty abatement offers relief for those with a history of compliance facing unexpected financial hardship and usually processes within 2-4 months. Currently Not Collectible status can be granted relatively quickly once you provide the required financial documentation. Having professional representation speeds up the process significantly because experienced tax professionals know exactly what documentation the IRS requires.

Question 4

What Happens To IRS Collection Actions While My Case Is Pending?

Accepted Answer

Once your case is properly submitted, the IRS suspends other collection activities in most situations. When you're working toward an Offer in Compromise, the IRS stops levies, wage garnishments, and other enforced collection actions while your offer is under review. You don't have to make payments on an existing installment agreement while your OIC is being considered. If you're already under a levy or wage garnishment, your representative can often get these released quickly by demonstrating you're working in good faith to resolve your debt through legitimate IRS programs. The IRS may still file a notice of federal tax lien during the process, but liens aren't released until your offer terms are satisfied. Professional representation ensures you get maximum protection from collection actions while your case moves through the system and helps secure lien withdrawals once payment arrangements are completed.

Question 5

Can I Handle Fresh Start Program Applications Myself Without Professional Help?

Accepted Answer

You can attempt to handle Fresh Start applications yourself, but success rates are significantly lower without professional representation. Not all taxpayers will qualify for an Offer in Compromise and the difference between those that qualify and those that don't is often the quality of the offer that they submit. If you don't meet the IRS requirements, your offer will be summarily rejected. Accurately completing the offer paperwork and correctly reporting your assets and income can have a dramatic effect on the likelihood that your offer will be accepted. The right help in this situation can be a game changer. Small errors or omissions can result in automatic rejection, and you may lose your application fee and any payments made during the review process. Pennsylvania taxpayers face additional complexity because they often owe both state and federal taxes. Pennsylvania has no statute of limitations on tax collection, meaning the state can pursue unpaid taxes indefinitely. Professional representation ensures you get comprehensive relief for all your tax problems rather than solving only part of your situation. Would you go to court without a lawyer? Of course not! Then why would you go before the IRS without a trusted tax professional?
