Question 1

How much tax debt qualifies for the IRS Fresh Start Program?

Accepted Answer

The IRS Fresh Start Initiative focuses on taxpayers owing $50,000 or less in combined tax, penalties, and interest. This threshold applies to your total federal tax debt, not individual tax years. If you owe more than $50,000, you may still qualify for other relief options, but the streamlined processes aren't available. Those under the threshold can qualify for streamlined installment agreements with manageable monthly payments. We analyze your complete financial picture to determine which programs offer the best outcome for your situation. The key is acting quickly. The IRS escalates cases through collections and may eventually file liens, garnish wages, or seize assets if you wait too long to address the problem.

Question 2

Can the Fresh Start Program completely eliminate my tax debt?

Accepted Answer

Yes, but complete elimination depends on your specific financial circumstances. The Offer in Compromise program allows you to settle your tax debt for less than the full amount owed, and in some cases, this can result in significant reductions. The IRS generally approves an offer when the amount represents the most they can expect to collect within a reasonable period. If you truly cannot pay your full debt due to financial hardship, Currently Not Collectible status can halt collection activities, though you may still be subject to a lien. Complete debt forgiveness is possible but not guaranteed. We evaluate your income, assets, and expenses to determine realistic expectations and pursue the maximum relief available under your circumstances.

Question 3

What happens if I don't qualify for Fresh Start?

Accepted Answer

Not qualifying for Fresh Start doesn't mean you're out of options. The program represents just one set of relief tools, and we have extensive experience with alternative solutions that can still provide significant relief. We can help assess your tax debt options and negotiate workable payment plans with the IRS even outside the Fresh Start framework. Custom installment agreements can offer longer payment periods or lower monthly payments than standard IRS agreements, and alternative OIC arrangements may still be possible. Unpaid back taxes rarely go away on their own, so taking action remains critical. We explore every available avenue to find a solution that works for your specific financial situation, whether through Fresh Start or other IRS programs.

Question 4

How long does the Fresh Start Program application process take?

Accepted Answer

The timeline varies significantly based on which Fresh Start option you pursue and the complexity of your case. Streamlined installment agreements for those owing less than $50,000 can be processed relatively quickly, often within 30-60 days. Offer in Compromise applications have up to two years for IRS determination, and your offer is automatically accepted if they don't respond within that timeframe. However, most cases receive decisions much sooner when properly prepared and submitted. The application process can be complex and challenging to navigate, making professional guidance invaluable for understanding the intricacies and increasing your chances of favorable outcomes. We handle all paperwork and communication to prevent delays and ensure your case moves as quickly as possible.

Question 5

Will applying for Fresh Start hurt my credit score?

Accepted Answer

Enrolling in a tax relief program does not hurt your credit score. The application process itself has no direct impact on your credit rating, and successfully resolving your tax debt actually helps protect your credit from future damage. However, the IRS doesn't release federal tax liens until your offer terms are satisfied, so existing liens remain on your credit report during the resolution process. Once you complete your agreement, liens are typically released, improving your credit situation. The bigger risk to your credit comes from not addressing tax debt. The IRS may place liens on your property or levies on your accounts, causing potentially ruinous financial damage. Taking action through Fresh Start or other relief programs protects you from these more severe collection actions that would significantly harm your credit.

Question 6

Do I need a lawyer to apply for the Fresh Start Program?

Accepted Answer

While you can technically apply yourself, the complex eligibility criteria and precision required in tax forms make professional guidance essential for success. The IRS processes thousands of applications, and small mistakes can lead to rejection and wasted time. The application process is complex and challenging to navigate, and professional expertise proves invaluable in understanding the intricacies and increasing your chances of favorable outcomes.
